Please note: On January 9, 2025, a federal court vacated the U.S. Department of Education’s 2024 rules related to Title IX, causing a reversion to the rules issued by the Department in 2020. As a result, some provisions of the August 23, 2024 version of the RPI Title IX and Sexual Misconduct Policy have also been invalidated. We will continue to follow the 2024 version of RPI’s policy, except for those provisions that do not comport with the 2020 rules.
In the coming weeks, we will publish a revised Title IX and Sexual Misconduct Policy that conforms to the court’s decision and any further direction issued by the US Department of Education or federal courts. In the interim:
- New complaints will be received and addressed using the definitions of conduct and investigation, hearing, and appeal procedures described in the 2023 version of RPI’s policy in accordance with the 2020 Final Rule. All other provisions of the 2024 version that were not invalidated by the court’s decision remain in effect;
- Pending complaints received before January 9, 2025 alleging conduct occurring before August 1, 2024 will continue to be addressed pursuant to the 2023 version of RPI’s policy;
- Pending complaints received before January 9, 2025 alleging conduct occurring on or after August 1, 2024 were received pursuant to the 2024 policy. Due to the court's decision invalidating certain provisions of the 2024 policy, Complainants and Respondents in these matters will receive an update from a Title IX Coordinator clarifying the resolution procedures to be used moving forward.
Please note that discrimination and harassment on the basis of gender, gender identity, gender expression, transgender status, sex stereotypes, and sexual orientation are still prohibited by New York State law.
